1. Acceptance of Terms

By accessing or using orchestr.sh ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

orchestr.sh provides a platform for deploying and managing multi-agent AI systems to your cloud infrastructure. The Service includes:

  • Cloud infrastructure orchestration
  • Multi-agent AI system deployment
  • Dashboard and monitoring tools
  • API access for automation

Early Access Notice: The Service is currently in early access. Some features, including automatic infrastructure provisioning, are under development and may not be fully available.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Cloud Provider Credentials

When you connect your cloud provider account (AWS, GCP, Azure), you grant us permission to:

  • Store your encrypted cloud credentials
  • Provision infrastructure in your cloud account
  • Manage resources on your behalf

Important: You are solely responsible for costs incurred in your cloud provider account. We encrypt your credentials using AES-256-GCM encryption, but you should review our Privacy Policy for details on data handling.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purposes
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or malicious code
  • Attempt to gain unauthorized access to our systems
  • Abuse or overload our infrastructure
  • Use the Service to deploy systems that violate AI provider terms (OpenAI, Anthropic, etc.)

6. Fees and Payment

orchestr.sh may charge fees for certain features. You agree to:

  • Pay all applicable fees
  • Provide valid payment information
  • Pay for cloud infrastructure costs in your own account

Fees are non-refundable except as required by law or specified in our refund policy.

7. Beta and Early Access

Some features may be offered as beta or early access. These features are provided "as is" and may contain bugs or limitations. We may discontinue beta features at any time.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by orchestr.sh and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data, code, or configurations you create using the Service.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and data
  • You remain liable for any fees owed

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

IN NO EVENT SHALL ORCHESTR.SH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability shall not exceed the fees you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless orchestr.sh from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Costs incurred in your cloud provider account

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
